General Conditions of Sale (GCS)

1. Purpose

These General Conditions of Sale (GCS) govern sales made on the site fymobeauty.com , operated by FYMO BEAUTY , a self-employed company registered under SIRET 294 567 839 256, whose head office is located at 123 Avenue de la Beauté, 75001 Paris, France.

Any order placed on the site implies full acceptance of these T&Cs.

2. Products

The products offered are described and presented with the greatest possible accuracy. However, a slight difference in presentation (color, packaging) may exist without FYMO BEAUTY being held liable.

3. Price

Prices are indicated in euros (€), all taxes included (TTC), excluding delivery costs.
FYMO BEAUTY reserves the right to modify its prices at any time, but products will be invoiced based on the rates in effect at the time of the order.

4. Order

Any order implies acceptance of the prices and descriptions of the products available for sale.
FYMO BEAUTY reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

5. Payment

Payment is due immediately upon ordering.
Payments are secured via the solutions offered by Shopify (bank cards, PayPal, etc.).
FYMO BEAUTY never has access to customer banking data.

6. Delivery

  • Delivery in mainland France within 3 to 5 working days (indicative delivery times).

  • Any delays do not give rise to cancellation of the order or to damages.

  • Delivery costs are specified when ordering.

  • The customer is required to check the condition of the package upon receipt and to report any anomalies within 48 hours.

7. Right of withdrawal

In accordance with the law (articles L221-18 et seq. of the Consumer Code), the customer has a period of 14 days from receipt of the product to exercise his right of withdrawal, without having to justify his decision or bear any costs other than the return costs.
⚠️ Used, damaged or incomplete products will not be returned or refunded.

8. Returns & Refunds

In the event of exercising the right of withdrawal, the customer must return the products to the address provided by FYMO BEAUTY.
The refund will be made within 14 days of receipt of the return, via the same payment method used when ordering.

9. Legal guarantees

FYMO BEAUTY is bound by legal guarantees:

  • Guarantee of conformity (articles L217-4 to L217-14 of the Consumer Code).

  • Guarantee against hidden defects (articles 1641 to 1649 of the Civil Code).

In case of defective product, the customer can request repair, replacement or refund of the product.

10. Liability

FYMO BEAUTY cannot be held responsible for any damage resulting from improper use of the product purchased.
FYMO BEAUTY cannot be held liable for indirect damages linked to the use of the products (loss of data, loss of turnover, etc.).

12. Consumer mediation

In the event of a dispute, the customer must first contact FYMO BEAUTY customer service.
In the absence of an amicable solution, the consumer may have recourse free of charge to a consumer mediator in accordance with articles L612-1 of the Consumer Code.

13. Applicable law

These T&Cs are subject to French law .
In the event of a dispute, and in the absence of an amicable agreement, the French courts will have sole jurisdiction.
